Talks successfully concluded

K+S and Gerstungen agree on a settlement

The Thuringian municipality of Gerstungen and K+S have successfully ended the talks begun in July and have set aside their long-standing dispute.

A long-term agreement has been concluded to secure the municipality’s drinking water provision. It will also secure continuing potash production in the Hesse-Thuringia potash district, on which – being a significant regional industry – well over 4,000 jobs depend, until deep-well injection of saline wastewater is terminated and long afterwards. In addition, K+S undertakes to support the municipality in implementing an action plan to optimize its drinking water provision. Overall, the commitments to be taken on by the company fall within the single-digit million euro range.

The Gerstungen municipality has undertaken to end the suit and urgency procedure it initiated against water permits in connection with saline wastewater injection and the Gerstunger Mulde buffer which has not been in operation since 2007, and to promote an amicable settlement of the proceedings against the saline wastewater discharge into the Werra.

“I am pleased that, after the settlement with the BUND, we have now also concluded an agreement with the Gerstungen municipality, from which both the environment and jobs will profit to an equal extent,” says Dr. Burkhard Lohr, chairman of the Board of Executive Directors of K+S Aktiengesellschaft. “Ms Hartung proved to be a reliable negotiating partner in the talks, presenting her case with great commitment. I am utterly convinced that on this basis we have taken the right path in paving the way for environmentally friendly potash mining in the future.”

Sylvia Hartung, mayoress of the Gerstungen municipality, stresses: “I am very pleased that we have reached a joint solution and am sure that in the future too we will be able to act together. Only in this way can everybody’s interests in the region be protected. The spirited determination with which Dr. Lohr approached the Gerstungen municipality, as well as the constructive talks, have consequently produced the expected results.”

The agreement between K+S and the Gerstungen municipality has a term of 30 years. The parties undertook to endeavor to reach amicable solutions in the event of any disagreements beyond that period too.
