Verband Hessischer Fischer’s appeal fails

The Hesse Higher Administrative Court (VGH) has turned down the appeal by Verband Hessischer Fischer e.V. in the dispute over discharge permission for saline waste water.

The proceedings initially concerned an emergency appeal by the fishermen’s association, by which the approval given by Kassel Regional Council for the discharge of saline waste water into the Werra was to have been cancelled. The association was unsuccessful both before the Administrative Court and also on 24 April 2014 with its appeal before the Hesse Higher Administrative Court.

The fishermen’s association’s application to have the appeal heard has now been turned down by the Higher Administrative Court in the final instance, because, inter alia, the original lawsuit had not been filed on time.

The costs of the proceedings were charged to the association.
