Werra plant: Emergency appeal rejected

Administrative Court confirms discharge permission

The Hesse Higher Administrative Court (Hessischer Verwaltungsgerichtshof, VGH) in Kassel has rejected the appeal of Verband Hessischer Fischer e.V. against a decision by the Kassel Administrative Court of 29 April 2014. With its emergency appeal, the association had attempted to cancel the approval given by Kassel Regional Council for the discharge of saline waste water into the Werra, and had failed to do so already in the lower instance.

The VGH also dismissed the action as being inadmissible. According to the Court, the applicant had already known about the water-law permission of 30 November 2012 granted by Kassel Regional Council to the Werra plant since it was made public at the beginning of December 2012. However, the association did not file its emergency appeal until more than a year after the discharge permission came into effect. The costs of the proceedings were charged to the plaintiff.
