Werra Plant: Hesse Fishing Association’s emergency application dismissed

Administrative Court Affirms Discharge Permit

The Kassel Administrative Court has dismissed an emergency application filed by the Hesse Fishing Association against the permit for the discharge of saline wastewater of the Werra Plant. This means that the permit issued by the Kassel Regional Council at the end of 2012 remains valid.

The court dismissed the action as “clearly inadmissible”. The 4th Chamber found that the plaintiffs were already aware of the water-law permit issued by the Kassel Regional Council to the Werra Plant as far back as 30 November 2012. However, the association only filed its emergency application more than one year after the discharge permit had entered into force. The plaintiffs were ordered to bear the costs of the proceedings.
